WhipRate Terms of Service and End User License Agreement

1. Acceptance of Terms

By accessing or using the WhipRate mobile application ("App") and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. User Responsibilities and Content Guidelines

2.1 Zero Tolerance for Objectionable Content

WhipRate maintains a ZERO TOLERANCE policy for objectionable content. Users agree not to post, upload, share, or otherwise distribute:

• Content that is defamatory, obscene, pornographic, or sexually explicit
• Content that promotes violence, harassment, or hatred
• Content that infringes on intellectual property rights
• Spam, misleading information, or deceptive content
• Content that violates any applicable laws or regulations

2.2 User Conduct

You agree to:

• Provide accurate and truthful information
• Respect other users and their content
• Use the App for lawful purposes only
• Not engage in any behavior that disrupts or interferes with the App's functionality
• Report objectionable content promptly

3. Content Moderation

3.1 User Reporting and Flagging

Users may flag content they believe violates these Terms. Flagged content will be:

• Hidden from the reporting user's feed immediately
• Reviewed by our moderation team

3.2 User Blocking

Users may block other users to prevent seeing their content. This action:

• Immediately removes all content from the blocked user from your feed
• Notifies our moderation team for review

3.3 Developer Response Commitment

WhipRate commits to:

• Review all reported content within 24 hours
• Take appropriate action on confirmed violations
• Remove objectionable content promptly
• Suspend or terminate accounts that violate these Terms

4. Content Ownership and Rights

4.1 Your Content

You retain ownership of content you post. By posting content, you grant WhipRate a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App.

4.2 Respect for Others' Rights

You represent that you have the right to post any content you share and that it doesn't violate others' rights.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

6. Enforcement and Consequences

6.1 Violations

Violations of these Terms may result in:

• Content removal
• Account suspension
• Permanent account termination
• Reporting to law enforcement when appropriate

6.2 Appeals

Users may appeal moderation decisions by contacting support within 30 days of the action.

7. Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind. WhipRate does not guarantee:

• Continuous, uninterrupted access
• Accuracy of user-generated content
• Freedom from offensive material despite our moderation efforts

8. Limitation of Liability

WhipRate shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

10. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our sole discretion.

11. Governing Law

These Terms are governed by the laws of the United States and the State in which WhipRate operates.
